By accessing or using this website, or by submitting any form on it, you acknowledge that you have read and agree to these Terms of Service, including the disclaimer of warranties (Section 2), the limitation of liability (Section 3), and the agreement to resolve disputes by individual binding arbitration with a jury-trial and class-action waiver (Section 11). If you do not agree, do not use the site.
1. A free, informational directory

Listings contain factual information such as business name, street address, telephone number, category, opening hours and approximate location. The site is provided at no charge, for general informational purposes only. There is no account to create, nothing to buy, and no fee of any kind to any visitor or to any listed business. Nothing on this site is professional, legal, financial, or other advice.
2. No warranties — the site is provided "AS IS"

3. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Zvario LLC, AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SITE OR ANY LISTING, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE THE SITE IS PROVIDED FREE OF CHARGE AND YOU PAY US NOTHING, THE TOTAL AGGREGATE LIABILITY OF Zvario LLC FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100.00). This limitation applies even if a remedy is found to fail of its essential purpose. Each part of this section is independent: if any exclusion or limitation is held unenforceable, the remaining exclusions and limitations still apply to the fullest extent permitted by law. Some jurisdictions do not allow certain of these exclusions, so parts of this section may not apply to you.
4. Listings, and removal on request
A business does not have to ask to be listed, and being listed creates no relationship, agency, endorsement or obligation between that business and Zvario LLC. Listing is free and signs no one up for anything.
Any business may have its listing removed on request, free, and we will action it promptly. We will not ask you to prove ownership, ask why, or try to retain you. Use the removal button on the listing or tell us here. Prompt, no-charge removal is available as a remedy for any concern a listed business has about its own listing.
5. Third-party businesses, links and content
Sioux Falls Local reports factual records about independent third-party businesses. Zvario LLC does not control, verify, endorse, or take responsibility for those businesses, for their acts or omissions, or for any third-party website a listing links to. Any dealing you have with a listed business is solely between you and that business. To the extent any listing or linked material includes information provided by a business or another third party, Zvario LLC acts only as an interactive computer service publishing that information and is not the speaker or publisher of it for purposes of any claim based on that third-party-provided content.
6. Copyright and DMCA notices
Zvario LLC respects copyright. If you believe material on this site infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent, including all elements the statute requires (identification of the work, identification and location of the material, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorised to act). We will respond as the DMCA provides, and we may remove material and terminate repeat infringers.

7. Availability of the site
We may modify, suspend, or discontinue the site, any listing, or any feature at any time, with or without notice, and without liability to you. We do not promise the site will be available or uninterrupted.
8. Acceptable use
You may view and use the site for your own personal, non-commercial reference. You may not scrape, crawl, harvest, copy, republish, resell, or create a competing or derivative dataset from the compiled contents of this site; use the site to send unsolicited communications; introduce malware or attempt to breach or overload it; or use it in violation of any law. The compiled directory, the category introductions, guides, descriptions, layout and design are owned by Zvario LLC; the underlying facts about businesses are not owned by anyone.
9. Submissions
If you submit a correction, a request to add a business, or any other message, you confirm the information is accurate and that you are authorised to provide it. You grant Zvario LLC a non-exclusive, royalty-free licence, perpetual as to materials already incorporated into the directory, to use it to operate the directory. We may contact you at the email address you provide to process your request. If you separately opt in to marketing, you may withdraw that at any time by telling us.
10. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Zvario LLC and its members, managers, officers, employees and agents from and against any claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, your submissions, or your breach of these terms.
11. Binding arbitration and class-action waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
You and Zvario LLC agree that any dispute, claim or controversy arising out of or relating to the site or these terms will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Remote proceeding. The arbitration will be conducted by videoconference or by written submissions wherever the AAA rules permit, and any in-person element will be held in Minnehaha County, South Dakota. The parties intend that a party located outside the United States may participate entirely by video.
Class-action and jury waiver. All claims must be brought in your or our individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. You and Zvario LLC waive any right to a jury trial.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to stop infringement or misuse of its intellectual property or the site (Sections 6 and 8). These exceptions are not a waiver of this arbitration agreement.
30-day opt-out. You may opt out of this arbitration and class-action-waiver section by telling us in writing within 30 days of your first use of the site, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these terms.
Time limit. Any claim must be commenced within one (1) year after it arose, or it is permanently barred, to the extent the law allows such a limit.
12. Governing law, and court disputes
These terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules. For any matter that is not subject to arbitration under Section 11 (including the exceptions in that section, or if the arbitration agreement is found not to apply), the exclusive venue is the state courts located in Minnehaha County, South Dakota, or the United States District Court for the District of South Dakota, and you consent to the personal jurisdiction of those courts.
13. Changes, severability, and entire agreement
We may update these terms at any time; the date above shows when they last changed, and continued use after a change means you accept it. If any provision is held unenforceable, it is limited or severed to the minimum extent necessary and the rest stays in force. Our failure to enforce any provision is not a waiver. These terms, with the Privacy Policy, are the entire agreement between you and Zvario LLC regarding the site.
